1. Parties and scope
These terms govern the use of the website operated by [COMPANY LEGAL NAME] ([ADDRESS]; hereinafter “Laracalls” or “we”) and set out the general rules of the Laracalls service. By using the site, you are deemed to have accepted these terms; if you do not accept them, please do not use the site.
The scope, fees, term, service level and data processing terms of the service are set out in a separate service agreement entered into with each customer. In the event of a conflict between these terms and the service agreement, the service agreement prevails.
If you use the site or the service on behalf of a company, you represent that you are authorized to bind that company to these terms.
2. Definitions
- Site: the Laracalls website and its subpages.
- Lara: the Turkish-speaking AI sales assistant developed by Laracalls that holds phone conversations on behalf of businesses.
- Service: all services provided by Laracalls, including the setup and operation of Lara, call-quality monitoring, and the dashboard provided to the customer.
- Customer: a business that has entered into a service agreement with Laracalls.
- Person called: a person whom Lara calls or speaks with on the customer's behalf.
- Dashboard: the online interface where the customer reviews calls, recordings, transcripts and outcomes.
3. Use of the website
You may use the site only for lawful purposes and in accordance with these terms. When using the site, you agree not to:
- attempt to disrupt the site's operation, overload it, or circumvent its security measures,
- gain unauthorized access to the site, scrape the site in bulk with automated tools, or copy its content,
- upload malicious software to the site or prevent others from using the site,
- enter another person's information or false information in the demo or contact forms.
The sample call recordings and transcripts on the site are provided for information purposes. The names of individuals in these recordings have been concealed. You must obtain our prior written permission to download, reproduce or publish the recordings elsewhere.
The information on the site is for general promotional purposes and does not constitute an offer; binding terms are set out in the service agreement.
4. General framework of the service
On the customer's behalf, Lara phones leads and customers, answers their questions, handles their objections, talks with them about an appointment or a sale, writes the call summary into the customer's CRM, and may make a confirmation call before the appointment. Laracalls is responsible for setup and for monitoring call quality; the customer does not need to do any technical work.
Lara speaks on the basis of information provided by the customer (such as products and services, prices, promotions and the appointment calendar). The customer is responsible for ensuring that this information is accurate, up to date and lawful.
Lara is an AI system. She is set up and monitored with care; even so, during a call she may misunderstand a question or give an incomplete or incorrect answer. Call recordings and transcripts are available in the dashboard for the customer to review.
5. Customer responsibilities
The people Lara calls are the customer's own contacts; it is the customer's responsibility to ensure there is a legal basis for calling them. In particular, the customer undertakes the following:
- Call permission and legal basis: to obtain the necessary permission, or establish another legal basis, for each person to be called; for promotional or sales calls, to obtain the commercial electronic communication consents required under Law No. 6563 on the Regulation of Electronic Commerce and the related regulation, and to fulfill its obligations relating to the Message Management System (IYS).
- Notice: to inform the people called, as required under KVKK (Turkey's Personal Data Protection Law No. 6698) and related legislation, about the processing of their personal data, the recording of the call, and the fact that the call is conducted by an AI assistant.
- Opt-outs: to remove from the call list anyone who says they do not want to be called, and to pass these requests on to Laracalls.
- Accurate information: to provide the information Lara will use in an accurate, up-to-date and lawful form.
- Dashboard security: to grant dashboard accounts only to its authorized employees and to protect login credentials.
Laracalls does not collect call permissions or consents on the customer's behalf and does not warrant that the customer's consent processes comply with the law. The customer bears any claims and damages arising from its breach of these obligations; details are set out in the service agreement.
6. Prohibited use
The service may not be used for the following purposes or in the following ways:
- calling people without permission or a legal basis; mass unsolicited calling (spam),
- hiding or spoofing the caller number or identity; impersonating another person, organization or brand,
- misleading the person called about the fact that they are speaking with an AI assistant,
- providing misleading, deceptive or false information; fraud,
- promoting or selling illegal products or services,
- conversations involving threats, harassment, insults or discrimination,
- unlawfully collecting personal data, in particular special categories of personal data,
- using a real person's voice, or a voice resembling it, without that person's permission,
- attempting to reverse engineer or copy the service or the dashboard, or to circumvent their security measures,
- any use that violates applicable law.
If we detect, or reasonably suspect, use that violates these rules, we may stop calls, suspend the service and notify the competent authorities.
7. Intellectual property
The site, Lara, the dashboard, and the software, design, text and images that make them up, as well as the “Laracalls” and “Lara” names and logos, are owned by or licensed to Laracalls. These terms grant you no rights in them other than the right to use the site in accordance with these terms.
The data and content the customer provides to the service, and the recordings of calls made on the customer's behalf, belong to the customer. Laracalls uses them to provide the service and within the limits set out in the service agreement.
We may use any suggestions and feedback you send us about the service to improve the service, without incurring any obligation to you.
8. Third-party links
The site may contain links to third-party sites or services. Laracalls is not responsible for the content or privacy practices of these sites; when you use them, you are subject to their own terms.
9. Limitation of liability
The site is provided “as is” and “as available”. We do not guarantee that the site will operate without interruption or error, or that the information on the site will always be complete and up to date.
Results shared on the site reflect a specific customer's experience; they do not mean that another business will achieve the same results, and they are not a guarantee of results.
To the extent permitted by law, Laracalls is not liable for indirect damages, loss of profit, loss of data or loss of reputation arising from the use of, or inability to use, the site. The scope and maximum amount of liability in connection with the service are set out in the service agreement.
The limitations in this section do not apply in cases of willful misconduct or gross negligence, or to any liability that cannot be limited under applicable law.
10. Changes
We may update these terms from time to time. The current version is always on this page, and the date at the top of the page shows the latest change. If you continue to use the site after a change, you accept the updated terms.
If any provision of these terms is held to be invalid, the remaining provisions remain in full force and effect.
11. Governing law and jurisdiction
The law governing these terms and the courts with jurisdiction over disputes arising from them: [GOVERNING LAW / COMPETENT COURT]. If the service agreement provides otherwise, the service agreement applies.
